Terms of Service & End User License Agreement (EULA)

Upon downloading or utilising the Application, you are automatically agreeing to the following terms, which serve as the End User License Agreement (EULA) between you and the Service Provider. It is strongly advised that you thoroughly read and understand these terms prior to using the Application. By creating an account and accessing user-generated content, you formally accept this EULA.

These terms and conditions apply to the ToyTreyd app (hereby referred to as "Application") for mobile devices that was created by James Heggs (hereby referred to as "Service Provider") as a Commercial service.

1. Eligibility and Age Requirements

You must be at least 18 years of age to create an account and use the Application. ToyTreyd is designed strictly for parents, legal guardians, and adults to exchange items intended for children. Children are strictly prohibited from using the Application. By creating an account, you represent and warrant that you are 18 years of age or older.

2. User-Generated Content (UGC) and Acceptable Use

The Application allows you to upload photos of toys, write descriptions, and send messages to other users. You are solely responsible for the content you generate. To ensure a safe community, you agree NOT to post or transmit any content that:

• Is illegal, defamatory, threatening, intimidating, or harassing.
• Contains sexually explicit material, nudity, or graphic violence.
• Promotes hate speech, discrimination, or harm against any individual or group.
• Infringes upon the intellectual property rights of others.
• Contains spam, scams, phishing attempts, or unauthorised advertising.

3. Objectionable Content and Zero-Tolerance Policy

There is no tolerance for objectionable content or abusive users. The Service Provider maintains a strict zero-tolerance policy regarding any violation of the acceptable use guidelines.

To maintain a safe environment, the Application provides the following mechanisms:

• Filtering and Moderation: The Service Provider reserves the right to review, filter, and remove any user-generated content that violates these terms without prior notice.
• Reporting Mechanism: Users can flag inappropriate content or abusive behaviour directly within the Application using the built-in reporting tools.
• Blocking Users: Users have the ability to instantly block other users to prevent further communication.
• Account Suspension: The Service Provider will act upon reports of objectionable content within 24 hours. Any user found to be creating objectionable content or engaging in abusive behaviour will have their account permanently suspended and their access to the Application revoked immediately.

4. Real-World Interactions and Liability Disclaimer

The Application acts merely as a platform to connect users interested in exchanging toys. The Service Provider does not conduct criminal background checks on its users, nor do we verify the safety, condition, or hygiene of the items being exchanged.

When you choose to meet another user in person to exchange an item, you do so entirely at your own risk. We strongly advise you to take standard safety precautions, such as meeting in well-lit, public locations during daylight hours.

To the maximum extent permitted by law, the Service Provider disclaims all liability, whether direct or indirect, for any harm, injury, loss of property, or damages that occur as a result of real-world interactions, meetups, or the use of items acquired through the Application.

5. Intellectual Property and Usage Rights

Unauthorised copying, modification of the Application, any part of the Application, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.

The Service Provider is dedicated to ensuring that the Application is as beneficial and efficient as possible. As such, they reserve the right to modify the Application or charge for their services at any time and for any reason. Any charges for the Application or its services will be clearly communicated to you.

6. Third-Party Services and Network Charges

Please note that the Application utilises third-party services that have their own Terms and Conditions. Below are the links to the Terms and Conditions of the third-party service providers used by the Application:

• Google Analytics for Firebase
• Firebase Crashlytics

Some functions of the Application require an active internet connection. The Service Provider cannot be held responsible if the Application does not function at full capacity due to lack of access to Wi-Fi. You accept responsibility for any data usage charges or roaming fees incurred from your mobile network provider while using the Application.

7. Artificial Intelligence (AI)

The Application incorporates Artificial Intelligence (AI) technologies to provide certain features or services. By using the Application, you acknowledge and agree that AI may be used to process data and deliver functionalities. The Service Provider ensures that all AI usage complies with applicable laws and is designed to benefit the user experience.

8. Changes to These Terms and Conditions

The Service Provider may periodically update their Terms and Conditions. Therefore, you are advised to review this page regularly for any changes. The Service Provider will notify you of any changes by posting the new Terms and Conditions on this page.
